Adoption Contract - WHWTCGA Westie Rescue The individual/family adopting the Westie named in this contract agrees to the following: No member of the adopting family has ever been charged and/or convicted of cruelty to animals. The Westie will be kept solely as a house pet. The Westie will never be used for breeding, fighting, or experimentation. The Westie will never be given, leased or sold to any person, laboratory or business. The adopting family/individual will provide sufficient food, water, shelter, & veterinary care. The adopting family/individual will provide indoor quarters for overnight rest & inside quarters for confinement when absent from the home. The adopting family/individual will maintain a current dog license as required by law & will have the Westie inoculated against disease, including rabies. The Westie will always have identifying tags on the dog’s collar. Microchip identification or tattoo is a requirement. If circumstances prevent the westie from being micro chipped at adoption, then the new owner agrees to have the dog micro chipped and registered and forward a copy to WHWTCGA at the address above. The adopting family/individual is strongly encouraged to provide a properly fenced yard. Invisible fencing is not recommended. If the yard is not fenced, the adopting family/individual agrees that the Westie will be leashed at all times when in an unsecured area. Unsupervised tethering is not considered adequate protection or restraint. The adopting family/individual agrees to make a donation of $275 to assist the West Highland White Terrier Club of Greater Atlanta, Inc. (the “WHWTCGA”) with expenses incurred when rescuing, fostering, & placing the Westie & other dogs for which WHWTCGA provides services. The WHWTCGA does not buy or sell dogs & this does not constitute the sale of this Westie. This $275 will include the westie microchip. If the new owner has to microchip at a later date, then the fee will be $250. The Westie will be spayed/neutered at the time of adoption except under the circumstances described below. If the Westie has been altered recently, the adopting family/individual will have the Westie examined within 7 days by a licensed veterinarian to certify that the dog is healing properly & to obtain medical advice on recovery procedures. If for any reason, the rescue Westie is unaltered, the adopting family/individual agrees to have the Westie spayed or neutered by _____ months from the date of this agreement (to be filled in at time of adoption) & adopter agrees to provide the WHWTCGA with a copy of the spay/neuter certificate within 7 days of surgery to the address above. If this action or proof is not forthcoming, then it can be construed as a breach of contract and WHWTCGA can ask that the westie be relinquished to the club. If this is not applicable, then it should be noted on this contract. Adopter agrees to take their westie to a veterinarian for annual care and will also take the westie to a veterinarian for any future care that has been recommended by either a veterinarian or WHWTCGA. These recommendations will be provided in writing on the accompanying adoption checklist. WHWTCGA can request proof that this recommended care has been performed as a condition of this contract. The adopting family/individual agrees to exercise caution when introducing the Westie to new situations. An adult should monitor interaction between the Westie & children at all times. Even if the Westie has received formal obedience training, a refresher course is strongly suggested. If the adopting family/individual wishes to relinquish the Westie for any reason, the Westie will be returned to a rescue representative of the WHWTCGA. The westie will not be sold or given to any other party. Any reimbursement of .expenses incurred by the adopting family or individual for the care of this Westie will not be reimbursed, The adopting family/individual agrees that if a rescue representative of the West Highland White Terrier Club of Greater Atlanta, Inc. determines that the terms of this agreement have not been met, the adopting family/individual will relinquish custody of the Westie to a rescue representative of the WHWTCGA , on demand, without incident. Should the Westie be returned to the WHWTCGA either because of violation of the terms of this agreement, or by the choice of the adoptive family/individual, or for any reason whatsoever, no portion of the $275 donation will be returned or refunded after 45 days from the date of the adoption. The WHWTCGA & its rescue representatives make no warranties or guarantees regarding the temperament, behavior, or physical condition of any adoptive Westie, nor do they guarantee it free of genetic defects. The adopting family/individual agrees to hold harmless & indemnify the West Highland White Terrier Club of Greater Atlanta, Inc. & its rescue representatives from all claims, demands, action, causes of action, or liability of any kind whatsoever arising out of or in connection with this adoption. Should any situation lead to legal process, the adopting family/individual agrees to be solely responsible for all costs, including attorney fees & court costs. The adopting family/individual hereby waives & releases the WHWTCGA & its agents or rescue representatives from any & all liability of any nature for injury or damage which the adopting family/individual or the Westie may suffer or cause. This specifically includes, but is not limited to, any injury or damage resulting from the action of this Westie. The adopting family/individual expressly assumes the risk & responsibility for claims by any member of the family or other person(s) made as the result of any action taken or behavior exhibited by this Westie.
